Dispute Resolution in Patna

Every dispute will be resolved in Patna. This applies to any dispute, claim or difference arising out of or connected with the booking, sale, lease, allotment, possession, payments, or these terms.

• Step 1, Discussion. The party raising a dispute must give written notice. Both parties will try to settle it by discussion in Patna within 30 days of that notice.
• Step 2, Arbitration. If it is not settled, it may be referred to a sole arbitrator appointed by mutual consent under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration is Patna, the language is English or Hindi, and the award is final and binding.
• Step 3, Courts. For any matter not referred to arbitration, and for interim relief and enforcement, only the courts at Patna, Bihar have exclusive jurisdiction. Both parties agree to this and waive any objection to Patna as the place of trial.

Nothing in this clause removes any right of the Buyer to approach the Bihar Real Estate Regulatory Authority or the consumer forum having jurisdiction, where the law gives that right.
